The following policy was adopted by the SAMCAR Board of Directors on June 27, 2018:
Designated REALTOR® (DR) who falsely certifies a LFRO (Limited Function Referral Office) agent who is later found to be engaged in listing, selling, leasing, renting, managing, counseling, appraising and/or arranging financing for real property (by means of zipForm transaction(s), MLS, or other activity) in the year of certification, will be required to pay a fine of $1500 for the first offense and $2500 for the second offense per falsely certified LFRO. Fine will be payable within 20 days of written notice to DR by the San Mateo County Association of REALTORS®. Further, the falsely certified LFRO will either be terminated from the brokerage, or the DR will pay the appropriate membership dues (also within 20 days of written notice). Failure of the DR to pay the fine and/or dues may result in the inactivation of the brokerage, and all agents within the brokerage, pursuant to Article IX, Section 4 of the San Mateo County Association of REALTORS® bylaws until the situation is remedied.
