FEMA Tells Flood Insurers to Curb Rate Hikes NOW

Insurance companies have been directed to stop charging full-risk premium rates for flood insurance on older properties sold after May 1, the Federal Emergency Management Agency (FEMA) mandated in a recent bulletin. The bulletin is FEMA's first directive at implementing the Homeowner Flood Insurance Affordability Act, enacted last month to curb escalating flood insurance premiums. The bulletin directs insurers to allow home buyers to assume the seller's premium rate until FEMA issues new rate tables and refunds excessive premiums as directed under the law.

While technical in some areas, the bulletin nonetheless states, "On March 21, 2014, President Obama signed the Homeowner Flood Insurance Affordability Act of 2014 (HFIAA) into law. Pub. Law No. 113-89 (Mar. 21, 2014). This law repeals and amends certain provisions of the Biggert-Waters Flood Insurance Reform Act, Pub. Law No. 112-141 (Jul. 6, 2012) and the National Flood Insurance Act of 1968, 42 U.S.C. §§ 4001-et seq.. FEMA has actively begun analyzing and prioritizing implementation of the HFIAA. FEMA appreciates your cooperation during our continued consultation with you (the insurance companies).

The purpose of this bulletin is to (mandate the insurance companies) stop charging full risk-rates for all types of Pre-Flood Insurance Rate Map (FIRM) properties covered by section 3 of the HFIAA which includes primary residences and businesses. Section 3 of the HFIAA requires FEMA and Write Your Own (WYO) companies to restore Pre-FIRM subsidized rates for the following properties: (a) Pre-FIRM properties that were not insured when Biggert Waters was enacted; (b) Pre-FIRM properties that were sold after Biggert Waters was enacted; and (c) policies for Pre-FIRM properties that were rated full-risk under Biggert Waters due to a lapse in coverage. (As required by the HFIAA, FEMA will continue to consult and coordinate with WYO insurers - Write Your Own (WYO) Principal Coordinators - and other stakeholders as we implement other provisions of the law, including premium refunds.)"

Effective May 1, 2014, FEMA is requiring the WYO Companies and the Direct Servicing Agent to use the appropriate October 1, 2013 Pre-FIRM Rate Tables when more favorable than full-risk rates for the following types of scenarios:
 
• New application for Pre-FIRM buildings rated in zones Unnumbered A, AE, A1-A30, AH, AO, V, VE, V1-V30 and D effective on or after October 1, 2013, and processed on or after May 1, 2014 (previously impacted by Section 100205 (g)(1) of BW-12);
 
• Pre-FIRM subsidized policies assigned to a new building owner upon a purchase occurring on or after July 6, 2012, where the endorsement is effective on or after October 1, 2013, and processed on or after May 1, 2014 (previously impacted by Section 100205 (g)(2) of Biggert-Waters);

• Reinstatement on or after October 4, 2012, of a lapsed Pre-FIRM subsidized policy processed on or after May 1, 2014 (previously impacted by Section 100205 (g)(3) Biggert-Waters);

• Renewal of all policies for Pre-FIRM buildings that were not insured when Biggert Waters was enacted in zones Unnumbered A, AE, A1-A30, AH, AO, V, VE, V1-V30 and D processed on or after May 1, 2014 (previously impacted by Section 100205 (g)(1) of Biggert-Waters); and

• Renewal of all policies for Pre-FIRM buildings that were purchased after Biggert Waters was enacted in zones Unnumbered A, AE, A1-A30, AH, AO, V, VE, V1-V30 and D processed on or after May 1, 2014 (previously impacted by Section 100205 (g)(2) of Biggert-Waters).

The November 3, 2026, General Election will include important local races throughout San Mateo County, including City Council elections and a special election for San Mateo County Board of Supervisors District 5. For SAMCAR members, local elections are particularly important. City councils and the County Board of Supervisors make decisions affecting housing, property rights, development, zoning, permitting, property transfer taxes, parcel taxes, sales taxes, fees, tenant protections, and the local business license taxes.

Redwood City Council Unanimously Opposes Rent Control Ballot Measure
In a decisive 6-0 vote, the Redwood City Council has officially opposed the Redwood City Fair and Affordable Housing Ordinance, which will appear on the November 3, 2026 ballot. The Council's decision follows an independent supplemental economic impact analysis that concluded the measure extends far beyond traditional rent control and could have significant unintended consequences for tenants, housing providers, affordable housing, and the City's financial stability. SAMCAR applauds the six Redwood City Councilmembers for carefully reviewing the analysis and taking a position based on the long-term interests of the entire community. We encourage Realtors, property owners, homeowners, and renters to learn more about the measure before casting their vote this November.

The National Association of REALTORS' REALTOR Party recently highlighted the repeal of Half Moon Bay's rent stabilization and rental registry policies as a Success Story highlighting SAMCAR efforts to pursue a disciplined, relationship-based advocacy strategy grounded in data, local experience, and constructive solutions. A significant upshot of this result is that even when rent control policies are already in place, they are not irreversible. REALTOR associations can play a decisive role by staying engaged after adoption, monitoring program outcomes, electing more supportive candidates, and using credible data to demonstrate when policies fail to meet their goals.
